Terms of Service

1. Purpose
2P2I Madagascar is a technological infrastructure platform that connects investors with verified real-estate agencies in Madagascar. These Terms of Service govern access to and use of the platform.
2. Acceptance
Use of the platform implies full and unreserved acceptance of these terms. If you do not accept these terms, please do not use the platform.
3. Role of 2P2I
2P2I is not a real-estate agency. We do not sell properties directly and are not a party to real-estate transactions. We are a technological intermediation platform.
4. User accounts
Three types of accounts are offered: investor, agency and administrator. Each user is responsible for the confidentiality of their credentials and for actions performed from their account.
5. Partner agencies
Agencies wishing to publish on the platform must submit a verification file. 2P2I reserves the right to accept or refuse any request, without justification.
5 bis. Agency obligations on document authenticity
By submitting a listing on 2P2I, the agency certifies under its full and entire responsibility that all documents provided (land title, land certificate, Legal Status Certificate, cadastral plan, seller identification, spouse's consent, partition deed, Fokontany attestation, tax receipts, etc.) are authentic, up-to-date and unforged. Any submission of a fake, falsified or fraudulent document constitutes a serious breach of these Terms and of the 2P2I Agency Charter, and triggers: (a) full reimbursement to the buyer of all fees incurred (2P2I service fees + official court fees + any proven damages), charged back to the offending agency; (b) immediate revocation of the Certified Agency 2P2I badge and any active commitment charter; (c) pursuit of applicable civil and criminal actions under Malagasy law. Before enforcing sanctions (b) and (c), 2P2I shall notify the agency of a single (1) reasoned written warning. The agency has fifteen (15) calendar days to submit written observations and remedy the situation. Sanctions (b) and (c) are pronounced only upon repetition of a breach of the same nature, and only after the agency has had the opportunity to present its defence in accordance with the principle of due process. Sanction (a) (reimbursement to the buyer) remains applicable from the first duly established occurrence, without prejudice to the agency's right of appeal.
6. Document verification
The document verification service is an optional premium service offered by 2P2I. Reports issued are indicative only and do not have the legal status of a notarial deed. Should the verification uncover falsified documents, the buyer is entitled to full reimbursement of fees incurred (service fees + court fees), charged back to the responsible agency pursuant to article 5 bis.
7. Liability
2P2I cannot be held liable for transactions carried out between investors and agencies. Information published on listing pages is provided by partner agencies under their sole responsibility; pursuant to article 5 bis, any culpable inaccuracy engages the financial and contractual liability of the agency.
